Driftwood man sentenced to prison

Having been found guilty of his third DUI charge in a tenyear period, Robert McMillan, 43, of Driftwood was given a one- to two-year state prison sentence on Tuesday as a minimum requirement of state law. Judge Masson remarked that, with McMillan's previous record, any lesser sentence would mitigate the severity of the situation.

In addition to jail time, McMillan was ordered to pay a $2,500 fine, a $1,952.50 restitution fee and perform 50 hours of community service. McMillan will also have his driving privileges suspended for 18 months.

After failing to appear in court for her sentencing on Tuesday, Carol Copp, 37, of Emporium was arrested that night on a bench warrant issued by Judge Masson.

Copp, who was at her place of employment when she was taken into custody, was to be sentenced for theft and forgery for the cashing of another woman's checks.

Copp was taken to Elk County Prison on Tuesday and on Thursday Judge Masson placed her in contempt for violating the court order to appear.

She will be held at Elk County until next month's return day, at which time she will be sentenced.

Next return day in Cameron County will be on Feb. 19.

John M. Uber, 37, of Emporium was arraigned on Tuesday for multiple offenses including DUI, eluding police, driving without a license, speeding and reckless driving. Uber, who was involved in a high-speed chase several months ago after fleeing officers during a routine traffic stop, was sentenced to 30 days in jail.

Due to his employment situation, Uber will serve his time during the weekends. He was also fined $750 and ordered to perform 50 hours community service.

A Port Allegany man, Raymond E. Austin, 21, was placed in the Accelerated Rehabilitative Dispositions (ARD) program after pleading guilty to several charges including DUI, driving while license privileges are suspended or revoked and careless driving.

Austin was ordered to pay over $,1000 in fines and courtrelated fees. He must also surrender his drivers license for 60 days and perform 35 hours of community service.

Steven E. Smoker, 32, of Emporium was scheduled to be sentenced for a DUI on Tuesday, but did not appear in court. Judge Masson issued a bench warrant for his arrest. Having heard this news, Smoker appeared before Masson on Thursday.

That sentencing took place after our deadline.
